1. Acceptance of Terms

   By accessing or using the LangX app (“the App”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

2. User Eligibility

   You must be at least 18 years old to create an account and use the LangX app. By using the App, you represent and warrant that you are at least 18 years old.

3. Account Registration and Security

   You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach of your account.

4. User Conduct

   You agree not to engage in any of the following activities while using the App:

   • Violating any applicable laws or regulations
   • Impersonating any person or entity or falsely stating or misrepresenting your affiliation with a person or entity
   • Posting or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
   • Engaging in any activity that interferes with or disrupts the App or the servers and networks connected to the App

5. Intellectual Property

   All content and materials available on the App, including but not limited to text, graphics, logos, button icons, images, audio clips, and data compilations, are the property of LangX or its content suppliers and are protected by international copyright laws.

6. Limitation of Liability

   To the extent permitted by applicable law, LangX and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

7. Termination

   LangX reserves the right to terminate or suspend your account and access to the App for any reason, including but not limited to a violation of these Terms and Conditions.

8. Changes to Terms and Conditions

   LangX may update these Terms and Conditions from time to time. You are advised to review these terms periodically for any changes.

9. Governing Law

   These Terms and Conditions are governed by and construed in accordance with the laws of The United States of America.

10. OpenAI API and Anonymous Data Usage

    When you use features powered by the OpenAI API within LangX Copilot, you agree to the following:

    • We may collect and send anonymized data to OpenAI, including text input and interaction data, session information, and usage patterns.
    • Any data sent to OpenAI is anonymized to protect your privacy. We do not send any personally identifiable information.
    • We use the anonymized data to provide advanced language learning features, improve the performance and accuracy of LangX Copilot, and develop new AI-powered functionalities.
    • You have the right to opt-out of features involving the OpenAI API by adjusting your settings or contacting us, though this may limit the functionality of certain features.

11. Compliance with Children’s Online Privacy Protection

    Depending on the countries where our app is available, some or all of the users in our target audience may be considered children. We comply with the Families policy whenever our app is being used by a child.

    This includes:

    • Ensuring that any content in our app that could be seen by children is appropriate for them.
    • Only displaying ads that are appropriate for children, whenever our app is being used by a child.
    • Only displaying ads that are from Google Play certified ad networks, or ads served by us, whenever our app is being used by a child. This includes ads for our own apps, or from partnerships with other brands.
    • Ensuring that our app (including all APIs, SDKs, and ads) complies with all applicable laws and regulations relating to children, such as the US Children’s Online Privacy Protection Act (COPPA), and the EU General Data Protection Regulation (GDPR).

    We either make our entire app compliant, or implement a neutral age screen and comply with the policy when the user is a child.
